New Law in Idaho: Bans the purchase of candy and sodas with benefits

The state becomes the first to restrict food purchases with federal benefits, but the measure could face obstacles

Lawmakers in Idaho have given the green light to an unprecedented initiative: banning the purchase of candy and soft drinks with benefits from the Supplemental Nutrition Assistance Program (SNAP). The measure, outlined in House Bill 109, has already been approved by the House of Representatives and the state Senate, and is now in the hands of Governor Brad Little for final approval.

A Decision Impacting Thousands of Families

The SNAP, also known as the food stamps program, provides assistance to low-income households to ensure access to food. In fiscal year 2024, 130,900 Idaho residents (approximately 7% of the state’s population) relied on the program. However, with this new legislation, restrictions could change the way these beneficiaries make their purchases.

A Debate Dividing Opinions

The approval of the bill was not without controversy. The Idaho House of Representatives passed it with 48 votes in favor and 20 against, after the Senate refined the definition of «candy» before approving it with 25 votes in favor and 10 against. However, the measure still needs approval from the U.S. Department of Agriculture (USDA) before implementation.

Health policy experts have expressed differing opinions. Christina A. Roberto, a professor at the University of Pennsylvania, argues that «soft drinks are poisoning our children» and that the government should not subsidize them. On the other hand, Valerie Imbruce, from Washington College, points out that «sugar is present in a wide variety of products, not just in candy and soft drinks», questioning the selective focus of the ban.

The Future of the Measure and Its Possible Expansion

If the governor signs the law, it would take effect on July 1. However, if the USDA rejects the request for Idaho’s exemption, the state would have to submit the request every year until it is granted.

The discussion about restricting certain SNAP purchases is not limited to Idaho. At the federal level, Congressman Josh Brecheen proposed the Healthy SNAP Act in January, which would prohibit the purchase of soft drinks, candy, and desserts with program benefits. With 42.1 million beneficiaries nationwide, any decision on this matter could impact millions of Americans.
